Terms of Service

1. About This Service

Zamch ("the App") is a mobile application for group planning and coordination, operated by Moritz Schafft, 34132 Kassel, Germany ("the Operator"). Contact: zamch@moalsc.com.

The App helps groups of people organize shared activities — whether that is living together, traveling, going out, or any other group endeavor. Features include shared shopping lists, calendars, expense splitting (including multi-currency), polls, chore and task management, packing lists, timelines and itineraries with location mapping, announcements, outings with travel and accommodation planning, whereabouts and availability tracking, check-ins with photo sharing, and payment method sharing for settling expenses.

By creating an account and using the App, you ("the User") agree to these Terms of Service ("ToS"). If you do not agree, you must not use the App.

Use of the App must at all times comply with applicable law, in particular the laws of the Federal Republic of Germany and the law of the jurisdiction in which you reside or from which you access the App.

2. Eligibility

You must be at least 16 years of age to use this App. By creating an account, you confirm that you meet this requirement. If you are under 18, you confirm that your legal guardian consents to your use of the App, to the extent required by applicable law.

3. Account & Responsibility

You are responsible for maintaining the security of your account credentials. You are solely responsible for all content you create, share, or submit through the App, including but not limited to shopping list entries, calendar events, expense records, votes, packing list items, timeline entries, chore assignments, announcements, travel and accommodation details, whereabouts updates, check-ins, photos, GIFs, and payment method information you choose to share.

4. Acceptable Use

You agree to use the App only for its intended purpose: planning and coordinating group activities such as shared living, trips, outings, and other collaborative endeavors. You must comply with all applicable laws, including but not limited to German law (in particular the Grundgesetz, BGB, StGB, and DSGVO) as well as the laws of your own jurisdiction. You must NOT use the App to:

  • Post, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable under German law or the law of your jurisdiction.
  • Plan, coordinate, or facilitate any illegal activities.
  • Upload photos, images, or other media that infringe third-party rights, contain illegal content, or violate personality rights (Persönlichkeitsrechte).
  • Distribute spam, malware, or unsolicited content.
  • Attempt to circumvent content restrictions, rate limits, or other safety measures.
  • Enter knowingly false location data, whereabouts, or other information intended to deceive other group members.
  • Impersonate another person or misrepresent your identity.
  • Collect, harvest, or store personal data of other users beyond what is displayed in the App.
  • Interfere with or disrupt the App's functionality or servers.

5. Content Moderation

The App employs automated content filtering and moderation. Content that violates these Terms may be flagged, removed, or result in account suspension. Users may report content they believe violates these Terms. The Operator reserves the right to review reported content and take appropriate action.

6. User-Generated Media

  • You may upload photos from your camera or photo library. Uploads are limited to 2 MB per file in JPEG, PNG, or WebP format.
  • The App supports disappearing photos that are automatically and permanently deleted from our servers after the expiration time you set.
  • You may share GIFs via the integrated Giphy service. GIF search queries are sent to Giphy's servers (see Privacy Policy, Section 5).
  • You are solely responsible for all media you upload or share. Do not upload content that you do not have the right to share, that violates third-party rights, or that is illegal under applicable law.

7. Rate Limits & Usage Restrictions

To prevent misuse, the App enforces rate limits on content creation (e.g., a maximum number of entries per time window) and character limits on text fields. Attempting to circumvent these limits is a violation of these Terms.

7a. Paid Subscriptions

The App is free to use for small groups (up to 5 members). Larger groups, and certain premium features, require a paid subscription purchased as an in-app purchase through the Apple App Store or (when available) Google Play.

Group Tiers (member limits and pricing):

  • Free: up to 5 members, EUR 0
  • Small: up to 10 members, EUR 9.99/year (annual) or EUR 4.99/event
  • Medium: up to 25 members, EUR 14.99/year or EUR 7.99/event
  • Large: up to 50 members, EUR 24.99/year or EUR 12.99/event
  • XL: unlimited members, EUR 39.99/year or EUR 19.99/event

Quick Action AI Premium (user-level): EUR 2.99/month or EUR 24.99/year.

Billing Models:

  • Annual subscriptions are charged at the start of each billing period and automatically renew for the same period unless cancelled at least 24 hours before the renewal date.
  • Event subscriptions are one-time purchases tied to a specific group (for short-term use cases such as trips, parties, or birthdays). They do not auto-renew. When the event group's subscription expires, the group becomes read-only and can be renewed or converted to an annual plan.

Payment Processing: All purchases are processed through the Apple App Store (iOS) or Google Play (Android). You are billed in accordance with the payment method stored with your Apple ID or Google account. Subscription management, renewals, and cancellations are handled through the Apple App Store's or Google Play's subscription settings. We do not store or have access to your payment credentials (credit card, PayPal, etc.).

Refunds: Refund requests must be directed to Apple or Google in accordance with their refund policies, as they act as the seller of record for the purchase. German consumer law protections (including the 14-day right of withdrawal for digital content, subject to the statutory exceptions under Section 356(5) BGB) apply and are honoured to the extent required.

Subscription Changes & Cancellation: You can change or cancel a subscription at any time through the Apple App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period.

Price Changes: The Operator may adjust subscription pricing. Price changes will be communicated through the App with reasonable notice before taking effect and will only apply to future billing periods.

7b. Placeholder Members

Group owners on the free tier may create up to 19 "placeholder members" — participant slots that are identified only by a display name chosen by the group owner. Placeholders do not correspond to real, signed-up users and have no access to the App themselves. A placeholder may later be merged into a real user account when that user joins the group, at which point the placeholder's activity (e.g., assignments, votes, expense shares) is transferred to the real account.

Placeholder accounts that are not merged with a real user are automatically deleted 30 days after creation.

The group owner is solely responsible for the names they assign to placeholder members. Names must not infringe personality rights (Persönlichkeitsrechte) or contain personal data of third parties beyond what is reasonable to identify a participant within the group.

8. Account Suspension & Termination

The Operator reserves the right to suspend or terminate any account, without prior notice, for:

  • Violation of these Terms of Service.
  • Illegal activity conducted through the App.
  • Abuse of the reporting system.
  • Any behavior that the Operator, at their sole discretion, considers harmful to other users or the service.

You may delete your account at any time through the App's profile settings. Upon deletion, your personal data will be removed in accordance with the Privacy Policy.

9. Intellectual Property

The App, its design, code, and branding are the property of the Operator. You retain ownership of content you create, but grant the Operator a limited license to store and display it within the App as necessary for its operation.

10. Limitation of Liability

The App is provided "as is" without warranties of any kind. The Operator is not liable for:

  • Content created by other users.
  • Loss of data, service interruptions, or technical failures.
  • Damages arising from your use of the App or reliance on its content.
  • Actions taken by other users within your group.
  • Accuracy or completeness of exchange rates or expense calculations.

To the maximum extent permitted by German law, the Operator's total liability shall not exceed EUR 50. This limitation does not apply to liability for intentional misconduct (Vorsatz), gross negligence (grobe Fahrlässigkeit), or injury to life, body, or health, which cannot be excluded under German law (BGB).

11. Changes to These Terms

The Operator may update these Terms at any time. Users will be notified of material changes and required to accept updated Terms to continue using the App. Continued use after notification constitutes acceptance.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. You are additionally obligated to comply with all laws applicable in your own jurisdiction when using the App. The courts of Kassel, Germany shall have exclusive jurisdiction for any disputes arising from or relating to these Terms, to the extent permitted by applicable law.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
